Detecting insurance lapses before dispatch
How to spot gaps in BMC filings and what to do when coverage looks thin.

where a lapse shows up
Insurers file cancellations with FMCSA. L&I is where you see the effective cancellation and any pending notice. A PDF certificate emailed last month does not override a cancellation on file today. If the producer forwards a “binder,” still wait for L&I. Binders are not BMC-91 filings.
Authority can still read Active while the BMC-91 is already pending cancel. Those are different boxes. Read both. 49 CFR Part 387 is the financial-responsibility rule. The public record of the filing is L&I.
SAFER will not save you here. QCMobile will not either if the payload omits the cancellation date. Open L&I the morning you cover, and again the morning of pickup if the first check is stale.
49 CFR 387.7 is the requirement to maintain the filing. Cancellation notice to FMCSA is how the public record changes. You are not the insurer’s customer on that notice. You are the broker who will be asked what the filing showed on pickup day.
pending cancellation is the usual miss
The filing still shows on file. A cancellation date sits in the future. Dispatchers read “on file” and stop. Pickup is after that date. That is a lapse you could have seen.
Do not cover when the cancellation date is on or before pickup. A producer email that “renewal is in process” is not an effective replacement filing. Wait until L&I shows the new BMC-91/91X or BMC-82 with an effective date that covers the move. Screenshot that pane. The email is not the record.
If pickup is today and cancellation is this afternoon, you do not have the afternoon. Fail closed.
certificate PDF versus filing
Certificates are producer documents. They can be outdated, issued to a DBA, or written for a different LLC. They can also be honest and still not filed. FMCSA enforces the filing.
Use a certificate to read deductibles, cargo limits, and exclusions after L&I is clean. Do not use it as the BI&PD system of record. If the PDF amount and the BMC-91 amount disagree, believe L&I for the federal minimum and call the producer about the rest.
Named insured on the PDF must still match the MC. A lapse check that ignores the name is incomplete. You can have a current filing on the wrong entity sitting in the same email thread.
morning-of-pickup check
Approval last Tuesday is a timestamp. Cancellations post after you onboard. The useful habit is L&I again the morning of dispatch, not a certificate in a drawer.
If you have not used the carrier in 30 days, treat it as a new insurance check even if they are on your approved list. Seasonal capacity is the same idea: idle is not approved. After-hours covers still need L&I. If the site is down, you do not have a pass on a carrier whose last insurance screen is weeks old.
Save the morning screen with the load. If something later goes wrong, the question will be what you checked that day, not what you checked at onboarding.
reinstatement after a gap
A new BMC-91 after a cancellation can leave a gap between the old ending date and the new effective date. Ask what happened in the gap. Do not assume nothing moved.
Re-download L&I after reinstatement. Do not reuse the old PDF. Confirm named insured and 387.9 amount again. Authority reinstatement, if it also lapsed, is a separate L&I read.
A gap plus a new cell plus a new email is an identity re-check, not only an insurance re-check. People shop new dockets when the old filing dies. Stay on the same legal entity you originally contracted. If the reinstatement arrives on a different LLC, that is a new carrier, not a renewal.
Ask the producer what cancelled. Non-pay, rewrite, and “we moved carriers” are different stories. You do not need their whole underwriting file. You need a date that covers pickup and a named insured that still matches.
amounts and cargo still apply
A current BMC-91 below 49 CFR 387.9 for this commodity is as unusable as a cancelled one. Hazmat minimums are in the 387.9 table. Ordinary property is $750,000 BI&PD for the usual for-hire CMV case. Do not treat that as cargo.
Cargo lapses are contractual unless a BMC-34 was part of your requirement. If you required cargo by agreement, a cancelled cargo policy is a fail even when BMC-91 is current. Read both lines. Keep them labeled. Do not tell a shipper “they’re insured” if you only looked at BI&PD.
worked desk: morning L&I versus last month’s PDF
The carrier was approved last month. The folder held a certificate dated 60 days earlier, $1,000,000 auto, no cancellation language. Dispatcher planned to send pickup numbers at 0700.
Morning-of-pickup L&I: BMC-91 cancellation pending, effective that afternoon. Authority still Active. Named insured still matched. The PDF still looked “current” if you did not open L&I.
Do not dispatch. Two days later a new BMC-91 posted. There was a gap. Ask what freight they hauled in the gap before you put them back on an approved list. Re-save L&I. Throw out the old PDF as the record of cover.
what this is not
This is not a prediction of claims outcomes. A current filing does not mean a later accident is covered under every endorsement. It means the federal public-liability filing was on file when you checked.
This is not cargo-claims advice. 387.9 is BI&PD. Certificates can still be wrong on exclusions after a clean BMC-91.
A lookup you ran last week is not this morning’s filing. Open L&I again before dispatch. Do not tell a shipper you get an email when a BMC-91 cancels unless you actually watch L&I.

- Pickup date/time versus cancellation effective date.

- No L&I access and the only evidence is an old PDF.
- Reinstatement after a gap with no explanation and a changed phone.
- Filed amount below 387.9.
- Named insured changed on the new filing to a different LLC.
