desk questions for this state

  • Does cargo-carried hint at produce, meat, or refrigerated food — and is the actual trailer a working reefer?
  • What is the set point, pulldown plan, and who downloads the recorder if the receiver rejects?
  • Does cargo insurance include refrigeration-breakdown coverage naming this motor carrier?
  • Can this power unit legally operate in California under current CARB truck rules?
  • Is L&I still Active the morning of pickup, with no pending cancellation before the load moves?

stop and do not cover

  • No breakdown coverage on a temperature-controlled invoice.
  • They cannot name the unit or the set point before cover.
  • California pickup/delivery and the office cannot say the truck is legal to enter.
  • L&I inactive or cancelling before pickup.

produce lanes are still ordinary authority

Census codes 10, 18, and 23 (produce, meat, refrigerated food) are MCS-150 hints. They do not prove a working reefer is on the yard in Fresno today. Ask for the unit, the set point, and who can download the recorder.

Federal BI&PD at $750,000 for typical interstate property does not pay for a pulldown failure in the Valley heat. Breakdown / refrigeration-failure coverage is a cargo-policy endorsement. Match named insured to the docket.

california entry is not an fmcsa cargo class

Trucks that operate in California can be subject to California Air Resources Board truck rules (including fleet requirements that apply to certain vehicles operating in the state). FMCSA authority does not waive that. Ask the carrier’s office whether this power unit can legally make this California pickup or delivery. Write the answer.

San Pedro Bay and Oakland import reefers still need a motor carrier with authority for the highway move. Terminal appointments, TWIC, and clean-truck programs at those ports are access control. They are not L&I.

set point and the rate con

Write the set point on the rate confirmation. Continuous versus cycle run is a written instruction when the product requires it. A driver who “always runs 34” is not a written instruction.

Re-open L&I the morning of pickup. Produce moves on short notice. Filings cancel on their own calendar. A cargo certificate from last season does not override a BMC-91 cancellation today.
