FMCSA vs California

An Active FMCSA property MC is interstate operating authority. It is not a California oversize permit, not IRP, not IFTA, and not intrastate authority. If this load never leaves California, ask whether they have the state credential — and still match legal name on L&I if an MC is on the rate con.

As of September 2026, table 1 to 49 CFR 387.9 still lists $750,000, $1,000,000, and $5,000,000. The January 16, 2026 change is broker/freight-forwarder BMC-84/85 at $75,000 — your house, not the truck. The March 2026 FMCSA notice still says: do not buy or sell a USDOT or MC outside a real corporate deal.

UCR is a separate annual filing. It is not BMC-91 and not a CA OS/OW permit. Confirm UCR on the national UCR site if your process requires it. Then come back to L&I for the truck.

Ask the carrier which legal entity holds the CA permit. If the permit is in a different LLC than the rate con, you do not have a carrier. Screenshot the permit with the load file. A verbal “we’re permitted in California” is not the portal.

  • Did you call the census telephone on SAFER, not the cell in the email?
  • If this shipment is over legal in California, is there a current Caltrans Transportation Permits permit for these dimensions and this route?
  • If they claim a leased truck, is that a Part 376 equipment lease — or a story that they bought the MC?
  • A CA MCP is not FMCSA operating authority. An FMCSA MC is not a CA MCP.
  • CARB / truck-and-bus rules can stop a truck that looks clean on L&I. Ask the carrier; do not invent a federal rating.
  • Dray at LA/LB still starts with legal name, DOT, and MC on L&I.
